Litigation Overview
The U.S. Copyright Act preempts all state control or regulation of copyright. In addition to state law claims for unfair competition or trademark infringement, the federal Lanham Act creates recourse under federal law for these types of claims. Consequently, the majority of intellectual property litigation is conducted in Federal Court, under a nationally uniform set of procedures and rules.
